Personal Data Protection and Processing Policy

I. Introductory Provisions

These business terms and conditions define and specify the rights and obligations of the seller and the buyer within the framework of contractual relationships concluded through the online store www.medicalinstitut.cz.

The buyer has the opportunity to review these business terms and conditions before submitting their order and is adequately notified of them in advance. By submitting their order, the buyer confirms that they have read and agree to these business terms and conditions.

The seller and operator of the online store www.medicalinstitut.cz is Alepe, s.r.o. with its registered office at Bedřicha Smetany 165/6, Vnitřní Město, 301 00 Plzeň, ID: 26351641, registered with the Municipal Court in Prague, file no. C 219717. All contractual relationships are governed by the legal system of the Czech Republic.

 

II. Payment and Business Terms and Conditions

At our clinic, you can pay for services/procedures/surgeries in several ways:

  • In cash
  • By bank transfer
  • ePayment via eKonto – for holders of an eKonto account (Raiffeisenbank a.s.)
  • By credit card
  • Option to pay with employee benefits (Benefit Plus, Gallery Beta, Sodexo)

 

III. Surgery Price, Deposit, and Due Date

The client will pay for the surgery to the clinic as follows:

A. Deposit

B. Balance Payment

The client agrees to pay the remaining balance of the surgery price to the clinic no later than the day the service/procedure/surgery is to be performed.

In case of payment by bank transfer:

The variable symbol will be the client's birth number.

 

IV. Cancellation of Surgery

In case of: Contractual Penalty of
Rescheduling more than 30 days before the procedure 0% of the paid deposit
Rescheduling less than 30 days before the procedure 50% of the paid deposit
Cancellation more than 30 days before the procedure 50% of the paid deposit
Cancellation less than 30 days before the procedure 100% of the paid deposit

If the client is late with the payment for the surgery, the obligation of the clinic, doctor, and facility to perform the surgery ceases.

The client is exempt from paying the contractual penalty in the case of:

a) Short-term illness, documented by a medical certificate, on the condition of rescheduling the appointment.

b) Long-term illness, documented by a medical certificate.

c) Serious reasons – accident, death in the family, documented by a confirmation.

In case of cancellation of the appointment and the surgery itself by the clinic, the clinic agrees to find a replacement date, and if a replacement date is not possible, it agrees to refund 100% of the deposit.

 

V. Subscription Cancellation

If the client is late with the subscription payment, the obligation of the clinic, doctor, and facility to perform the service ceases.

If the client cancels a subscription for a specific service, this subscription is converted into credits that can be used for other services or treatments.

If the appointment and the service itself are canceled by the clinic, the clinic agrees to find a replacement date.

 

VI. Complaint Resolution

Complaints can be submitted in writing / using the form, which you can find for download in our business terms and conditions on the website www.medicalinstitut.cz and at our receptions. If sending the complaint by post, please send it to the delivery address:

The client will receive a written response to the complaint within 30 days of delivery.

 

VII. Client Information on Risks

The client agrees to sign an informed consent form before the surgery, which contains essential information about the procedure and is an integral part of this contract.

 

VII. Gift Vouchers

Gift vouchers can be purchased from our e-shop www.medicalinstitut.cz or at the reception in several ways:

  • In cash
  • By bank transfer
  • By credit card

The validity of the vouchers is 12 months from the date of issue.

 

VIII. Gift Credits

Gift credits can be purchased from our e-shop www.medicalinstitut.cz or at the reception during the Christmas holidays and can be paid for in several ways:

  • In cash
  • By credit card

The validity of the gift credits is 12 months from the date of issue.

 

IX. Mandatory Information for Consumers on Out-of-Court Dispute Resolution

In the event of a consumer dispute, with the exception of disputes arising from contracts concluded in the field of health services, the subject of which is the provision of healthcare, including the prescribing, dispensing, and provision of medicinal products and medical devices according to Act No. 372/2011 Coll., on Health Services, as amended, the consumer may turn to a body for the out-of-court resolution of consumer disputes. The relevant body for the out-of-court resolution of consumer disputes in this case is: the Czech Trade Inspection Authority.

X. Personal Data Protection and Processing Policy

C 219717 (hereinafter referred to as the "Controller"), within the meaning of the General Data Protection Regulation of the European Parliament and of the Council (EU) No. 2016/679 on the protection of data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Regulation").

Your rights related to the processing of personal data

  • Right to erasure – your personal data will be erased without undue delay if any of the following reasons apply:
  • your personal data are no longer needed for the purposes for which they were processed,
  • you withdraw your consent to the processing of personal data, and it concerns data for which your consent is necessary, and at the same time, there is no other reason why these data can continue to be processed,
  • you exercise your right to object to the processing, or
  • you believe that the processing of personal data carried out by our company has ceased to comply with generally binding regulations.

  • Right to object to the processing of personal data that is carried out based on the legitimate interest of the company. Our company will then cease processing the personal data, unless there are compelling legitimate grounds for us to continue with such processing
  • Right to data portability – you have the right to receive from us all your personal data that you have provided to us and that are processed based on your consent or the performance of a contract

If you leave contact details in the contact form or undergo a service, we process the following data:

  • First name
  • Last name
  • Email address
  • Phone number
  • Health data

The above-mentioned personal data must be processed to ensure communication between you and the Controller so that your request can be handled. If you provide your health data, this is the processing of a special category of personal data. The processing of this category of personal data is voluntary, but necessary for the purpose of recommending the most suitable service. Because you express interest in the services of the controller, it is their legitimate right to regularly inform you about the current service offer in the form of a newsletter and SMS at the provided email address and phone number. You give your express CONSENT to this processing by a confirmation signed at the reception: "Consent to the processing of personal data."

The Controller, based on its legitimate interest, processes the email address and phone number for a period of 10 years from the granting of your consent. If you do not wish to receive current information about the controller's services in the form of a newsletter or SMS, you can unsubscribe by sending a written message to the email address info@medicalinstitut.cz or by unsubscribing in the commercial communication sent to you.

Other personal data are processed for the duration of the mutual communication about the controller's services, but for a maximum of 5 years. In the case of the realization of a service by the controller, we process personal data for at least 10 years to meet the requirements of the valid legislation of the Czech Republic.

Who processes the data?

The processing of personal data is carried out by the Controller, but other processors, collaborating healthcare providers, software/IT providers, system administrators, and marketing agencies, systems, and social networks may also process personal data for the Controller.

We ensure that all personal data are protected in accordance with valid regulations and that misuse or unauthorized access by third parties is not possible.
