Terms of personal data protection

I. Basic Provisions

1. The controller of personal data, in accordance with Article 4, point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: "GDPR"), is Alepe, s.r.o., ID: 26351641, with its registered office at Bedřicha Smetany 165/6, Vnitřní Město, 301 00 Plzeň (hereinafter: "controller").

3. Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

II. Sources and categories of personal data processed

1. The controller processes personal data that you have provided to him or personal data that the controller has obtained based on the fulfillment of your order.

2. The controller processes your identification and contact data and data necessary for the performance of the contract.

III. Legal basis and purpose of personal data processing

1. The legal basis for the processing of personal data is:

  • the performance of a contract between you and the controller in accordance with Article 6(1)(b) of the GDPR,
  • the legitimate interest of the controller to provide direct marketing (especially for sending commercial communications and newsletters) in accordance with Article 6(1)(f) of the GDPR,
  • your consent to processing for the purposes of providing direct marketing (especially for sending commercial communications and newsletters) in accordance with Article 6(1)(a) of the GDPR in conjunction with § 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, in the event that no goods or services have been ordered.

2. The purpose of personal data processing is:

  • to process your order and to exercise the rights and obligations arising from the contractual relationship between you and the controller; during the order, personal data necessary for the successful processing of the order (name and address, contact) are required. The provision of personal data is a necessary requirement for the conclusion and performance of the contract; without providing personal data, it is not possible to conclude or for the controller to perform the contract,
  • to send commercial communications and carry out other marketing activities.

3. The controller does not / does perform automated individual decision-making within the meaning of Article 22 of the GDPR. You have given your explicit consent to such processing.

IV. Data retention period

1. The controller retains personal data:

  • for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for 15 years from the termination of the contractual relationship).
  • for the period until the consent to the processing of personal data for marketing purposes is withdrawn, for a maximum of 10 years, if the personal data are processed based on consent.

2. After the retention period of the personal data has expired, the controller will erase the personal data.

V. Recipients of personal data (subcontractors of the controller)

1. The recipients of personal data are persons:

  • involved in the delivery of goods / services / the execution of payments based on the contract,
  • providing services for the operation of the e-shop (Shoptet) and other services in connection with the operation of the e-shop,
  • providing marketing services.

2. The controller does not / intends to transfer personal data to a third country (a country outside the EU) or an international organization. The recipients of personal data in third countries are providers of mailing services / cloud services.

VI. Your rights

1. Under the conditions stipulated in the GDPR, you have:

  • the right to access your personal data according to Article 15 of the GDPR,
  • the right to rectification of personal data according to Article 16 of the GDPR, or the right to restriction of processing according to Article 18 of the GDPR.
  • the right to erasure of personal data according to Article 17 of the GDPR.
  • the right to object to processing according to Article 21 of the GDPR and
  • the right to data portability according to Article 20 of the GDPR.
  • the right to withdraw consent to processing in writing or electronically to the address or email of the controller listed in Article III of these terms.

2. Furthermore, you have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to the protection of personal data has been violated.

VII. Conditions for securing personal data

1. The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.

2. The controller has taken technical measures to secure data repositories and repositories of personal data in paper form.

3. The controller declares that only persons authorized by it have access to personal data.

VIII. Final provisions

1. By submitting the order from the online order form, you confirm that you are familiar with the personal data protection conditions and that you accept them in their entirety.

3. The controller is entitled to change these conditions. The new version of the personal data protection conditions will be published on its website and at the same time, the new version of these conditions will be sent to your email address that you have provided to the controller.
